Terms of Service

The terms governing the use of the ProCake service. Transparency and simplicity, that's our commitment.

1. Purpose

These Terms of Service (ToS) govern the use of the ProCake service, a SaaS (Software as a Service) online management application designed for bakers, cake designers and pastry professionals.

ProCake is a cloud solution enabling artisan bakers to manage their entire business: order and quote management, customizable recipe catalog, cake design tools (automatic quantity calculations), profitability tracking, task and appointment management.

2. Plans and Pricing

ProCake offers three subscription plans, all with a free 7-day trial:

3. Free Trial Period

All new users benefit from a free 7-day trial period with no commitment. A credit card is required at sign-up but you will only be charged at the end of the trial period.

At the end of the trial period, you must subscribe to one of the plans to continue using the service. The first billing occurs immediately upon subscription, but the subscription officially starts only after the trial period ends.

Example: Sign up on October 1st, free trial until October 8th. If you subscribe on October 5th (payment of 9.90EUR), your subscription starts October 8th. Next payment: November 8th.

4. Payment Terms

Payments are secure and managed by Stripe, a PCI DSS Level 1 certified platform (highest security level).

Accepted payment methods:

  • Credit cards: Visa, Mastercard, American Express
  • Debit cards
  • Apple Pay
  • Google Pay

Not accepted: PayPal, bank transfers (may be added later).

Payment security:

  • Encrypted HTTPS connection
  • 3D Secure authentication supported
  • No banking data stored on ProCake servers
  • Only Stripe identifiers and the last 4 digits of the card are kept

5. Automatic Renewal

All subscriptions automatically renew at the end of each period (monthly, semi-annual or annual), on the same day of the month or year.

Payment is automatically charged to the registered credit card. A confirmation email is sent after each payment, with the invoice in PDF format.

In case of payment failure, Stripe will make 3 automatic retry attempts. After 3 failures, the subscription will be suspended and you will receive an email notification.

6. Commitment Period and Cancellation

No minimum commitment. All subscriptions are commitment-free and can be cancelled at any time, in one click from your account.

Cancellation procedure:

  1. Click the "Cancel my subscription" button in your account
  2. Confirm the cancellation
  3. Your subscription will be scheduled to end at the end of the paid period
  4. You retain full access until the end of the period
  5. You will receive a confirmation email

Important: No pro-rata refund is issued upon cancellation.

Example: Subscription taken out on October 1st (9.90EUR paid), cancellation on October 10th. You keep access until November 1st. No automatic renewal after that date.

Reactivation:

You can reactivate your subscription before the expiration date to resume automatic renewal.

7. Plan Change

You can change your subscription plan at any time. The system automatically calculates the pro-rata of the remaining time.

Upgrading to a higher plan:

  • Immediate change
  • Credit for remaining time on the old plan
  • Payment of the difference

Example: Monthly plan (9.90EUR), day 15 of the month. Credit of approximately 5EUR. Switch to annual plan (99EUR). You pay 94EUR (99EUR - 5EUR).

Downgrading to a lower plan:

  • Immediate change
  • Credit for the remaining amount
  • Following months are free until credit is used up

8. Satisfaction Guarantee

If ProCake doesn't suit you, we will fully refund you within the first 30 days of your subscription. No questions asked, no conditions.

To request a refund, contact us at contact@procake.fr.

After this 30-day period, no refund is issued upon cancellation, but you retain access until the end of your paid period.

9. Invoicing

A PDF invoice is automatically generated and sent by email after each payment. You can also find all your invoices in the payment history of your account.

Invoices contain: ProCake's name and address, your client information, the amount, the date, the invoice number and VAT (if applicable).

10. Customer Support

Our support team is available by email at contact@procake.fr.

  • Weekday response time: within 24 hours
  • Weekend response time: within 48 hours
  • For urgent requests, please specify in the email subject

The 6-month and Annual plans benefit from priority support and early access to new features.

11. Intellectual Property

The entire ProCake service (source code, interface, design, documentation) is the exclusive property of ProCake and MyCake. Any unauthorized reproduction, representation, modification or use is strictly prohibited.

The data you enter into ProCake (recipes, orders, clients) remains your property. You retain all rights to your content.

12. Service Availability

ProCake commits to providing a service accessible 24/7, with optimal uptime. However, interruptions may occur for maintenance, updates or technical reasons.

Planned maintenance will be announced in advance by email. In case of extended interruption, a proportional credit may be granted upon request.

13. Liability

ProCake is a management assistance tool. We make every effort to ensure the reliability of calculations and features, but cannot guarantee the complete absence of errors.

The user remains responsible for verifying information generated by the application (recipes, quantities, prices, invoices) before professional use.

ProCake cannot be held liable for loss of business, data loss or indirect damages resulting from the use or inability to use the service.

14. Modification of Terms

ProCake reserves the right to modify these Terms at any time. Users will be notified by email of any substantial modification at least 30 days before it takes effect.

Continued use of the service after the new Terms take effect constitutes acceptance of those Terms.

15. Applicable Law and Disputes

These Terms are governed by French law. In case of dispute, an amicable solution will be sought first.

Failing an amicable agreement, any dispute will be brought before the competent French courts.
